Protection of rights, etc., of certain persons under Section 229 | Bangladesh Labor Act -2006:
As per section-229(BLA-2006),
If any person refuses to participate or refuses to continue to participate in any illegal strike or illegal lock-out, they shall not, by reason of such refusal, be subject to expulsion from any trade union, or be liable to any fine or penalty, or be deprived of any right or benefit to which they or their legal representatives would otherwise be entitled, or be placed in any respect, either directly or indirectly, under any disability or at a disadvantage as compared with other members of the trade union concerned.
(3) If a person who has been dismissed from membership of a Trade Union files a complaint before the Labour Court, the court may, instead of ordering that the person be reinstated to his membership position, if it considers it appropriate, direct that a specified amount of money be paid to that person as compensation from the funds of the concerned Trade Union.
Simplified Version
When a Trade Union member is expelled and the matter goes to the Labour Court, the court may choose compensation instead of reinstatement and order the union to pay money from its funds to the expelled person.
