Unfair Labor Practices on the part of workers under Section 196
(1) No worker shall engage in any trade union activities during working hours without the prior permission of the employer:
Provided that, nothing in this sub-section shall apply to the President or General Secretary of a Collective Bargaining Agent (CBA) of an establishment while they are engaged in functions related to committees, negotiations, conciliation, mediation, or other proceedings under this Act, provided the employer is duly informed.
(2) No worker, group of workers, trade union, or any person acting on behalf of a union shall:
(Ka) Intimidate any worker into becoming, or refraining from becoming, a member or officer of a trade union, or to continue or cease to hold such a position;
(Kha) Induce any worker or other person to refrain from becoming, or to cease to be, a member or officer of a trade union by offering or promising any advantage;
(Ga) Compel or attempt to compel any worker to pay or refrain from paying subscriptions to a trade union fund by intimidation, use of force, pressure, threats, confinement, physical injury, or by disconnecting water, power, or telephone facilities, or by any other means;
(Gha) Compel or attempt to compel an employer to sign a settlement, or to accept or agree to any demand by intimidation, use of force, pressure, threats, confinement, eviction, dispossession, assault, physical injury, or by disconnecting water, [electricity, gas], or telephone facilities, or by any other means;
(uma) Commence or continue any illegal strike or "go-slow," or instigate others to participate in such actions; or
(Cha) Resort to Guerra (encirclement), obstruction of transport or communication systems, or destruction of property to achieve any demand or objective of a trade union.
(3) If a trade union, through its officers or any person acting on its behalf, interferes with an election held under Section 202 by undue influence, intimidation, impersonation, or bribery, it shall be deemed an Unfair Labour Practice on the part of the trade union.
(4) The Government shall develop a Standard Operating Procedure (SOP) for conducting investigations into matters of Unfair Labour Practices, consistent with the provisions of this section
