Authority to Order an Investigation into an Accident or Disease under Section 83 | Bangladesh Labor Act -2006:
As per section-83(BLA-2006),
(1) If, in any establishment, an accident occurs involving an explosion, ignition, fire, sudden rush of water, or any other accident, or if there is an outbreak or suspected outbreak of any disease mentioned in the Second Schedule in any establishment, and if the Government considers that a formal inquiry into the cause of such accident or disease and the surrounding circumstances is necessary, the Government may appoint any competent person to conduct such inquiry, and may appoint any person with special knowledge of law or the subject matter concerned to act as an Assessor during the inquiry.
(2) The said inquiring person shall have all the powers of a Civil Court under the Code of Civil Procedure relating to securing the attendance of any witness, or the production of any document or other object, and any person to whom he directs to furnish information for the inquiry shall be deemed to be legally bound to furnish it within the meaning of section 176 of the Penal Code.
(3) For the inquiry, the said inquirer may exercise any of the powers of a Labor Inspector under this Act, which he deems necessary to exercise.
(4) The inquirer shall submit his report to the Government, and this report shall record the cause of the accident and the circumstances related thereto, and shall also express any comments that he and the Assessor may have on the matter.
(5) The Government shall publish the said report at such time and in such manner as may be determined by it.
