Method of calculating wages under Section 152 | Bangladesh Labor Act -2006:
As per section-152(BLA-2006),
(1) For the purposes of this Chapter, "monthly wages" shall mean the amount of wages deemed to be payable for one month’s work, whether it be payable on a monthly basis or on the basis of any other period or at piece rates.
(2) Such wages shall be calculated as follows, namely:—
(Ka) Where the concerned worker was continuously employed for a period of not less than 12(twelve months) immediately preceding the accident under the employer liable to pay compensation, his monthly wages shall be one-twelfth of the total wages payable by the said employer during the preceding 12(Twelve months).
(Kha) Where the concerned worker was continuously employed for a period of less than one month immediately preceding the accident under the said employer, his monthly wages shall be an amount equal to the monthly average of the earnings of another worker employed in similar work under the same employer during the twelve months immediately preceding the accident, or if there is no such other worker, of another worker employed in similar work in the same area.
(Ga) In other cases, the monthly wages shall be an amount equal to 30(Thirty times) the total wages earned by the worker during his period of continuous employment under the employer liable to pay compensation immediately preceding the accident, divided by the total number of days in the said period.
Explanation: For the purpose of this section, a period of employment shall be deemed to be continuous if its continuity is not broken by an absence from work for a period exceeding 14(Fourteen days).
