Provision of Maternity Welfare Benefits in the Event of the Woman's Death under Section 49 | Bangladesh Labor Act -2006:
As per Section-49(BLA-2006),
(1) Entitlement to Maternity Benefit under this Chapter. If any woman who is entitled to receive maternity benefit under this Chapter dies during childbirth or within 60(days) thereafter, the employer shall pay such benefit:
To the person who takes charge of the care of the child, if the child survives; and if the child does not survive, to the person nominated by the woman under this Chapter, or, in the absence of a nominee, to the legal representative of the deceased woman.
(2) If any such woman dies during the period of her entitlement to receive maternity benefit, but before the birth of the child, the employer shall be bound to pay such benefit for the period up to and including the date of her death. However, any such benefit already paid shall not be recoverable, even if it exceeds the payable benefit. If any amount is due from the employer on this account up to the time of the woman's death, the employer shall pay it to a person nominated by the woman under this Chapter, or, in the absence of a nominee, to her legal representative.
